Effective Date:Jan 1, 2027
For the first time since HUD began implementing HOTMA Sections 102 and 104, the two largest program universes are working toward a single date.
Public housing agencies must be in full compliance with Sections 102 and 104 by January 1, 2027, under Notice PIH 2026-15, issued May 14, 2026. Multifamily housing owners face the same date under Notice H 2025-07, issued December 17, 2025.
The PIH track is not starting from zero on January 1. A first tranche of provisions — new income exclusions, certain definitions, and policies on de minimis errors — has been mandatory for public housing and Housing Choice Voucher programs since July 1, 2025. What arrives in January is HUD enforcement of the remaining Sections 102 and 104 provisions, along with the alternative HUD-50058 reporting instructions the notice sets out.
Notice PIH 2026-15 applies the January 1, 2027 enforcement date to non-MTW and non-FRS agencies. Moving to Work agencies and agencies in the FRS category should read the notice for how it treats them rather than assuming the general date applies.
Community Planning and Development grantees also received an extension. HOME, HOME-ARP, Housing Trust Fund, HOPWA, CDBG, ESG and Continuum of Care programs must be in full compliance by January 1, 2027 under HUD's December 30, 2025 extension.
## Analysis
Neither January 1, 2027 date is the first one set. Notice H 2025-07 supersedes Notices H 2024-09 and H 2025-03, and revises a compliance date previously set at January 1, 2025. Notice PIH 2026-15 partially supersedes Notice PIH 2024-38. Operators who have watched this date move repeatedly have some basis for skepticism that it will hold.
What is different this time is structural rather than rhetorical: two separate HUD program offices, in notices issued eight months apart, have independently landed on the same date. Prior extensions were single-office actions on separate timelines. That is not a guarantee — but it is a different posture than the serial one-office postponements that preceded it.
The preceding section is NSPIRE Wire editorial analysis, not HUD guidance.
1. Match each program to the current governing notice and confirm the effective dates of upcoming certifications and reexaminations.
2. For covered PHAs, coordinate software and reporting readiness with PIH 2026-15, including the permitted alternative instructions where applicable. Confirm that previously required provisions are already in place.
3. For multifamily operations, review the applicable income certification, documentation and policy requirements. For CPD activities in a mixed portfolio, use the December 30, 2025 extension rather than the superseded January 2026 date.
The cited PIH and Multifamily Housing notices align covered compliance obligations around January 1, 2027, but they do not make the implementation steps interchangeable. PHAs may already need to collect information for transactions effective in January. The later CPD extension also needs to be considered when planning a mixed portfolio.
PHAs subject to the January 2027 enforcement date and owners and agents in the multifamily programs covered by H 2023-10. Occupancy staff, compliance teams and software vendors need to follow the instructions for their program. MTW agencies and agencies exclusively using FRS have separate treatment under PIH 2026-15.
After three years of staggered postponements, public housing agencies and multifamily owners now face the same HOTMA compliance date. CPD grantees also received an extension to January 1, 2027.
