HUD & Affordable Housing Compliance Deadlines

MTW agencies and PHAs weighing MTW should review HUD's revised Operations Notice and comment by Nov. 2 on Regulations.gov (docket HUD-2020-0066). Changes include renaming the MTW Supplement to the MTW Plan-Expansion and decoupling it from the PHA Plan, removing the 10% HAP cap on local non-traditional activities, clarifying HAP renewal funding sources, updating the special purpose voucher renewal process, and correcting the MTW designation deadline to 2028.

Developers preserving affordable multifamily elderly housing in Florida must upload applications through Florida Housing Finance Corporation's online tool by 3:00 p.m. Eastern on November 10, 2026. RFA 2026-204 offers an estimated $5,317,810 in SAIL gap funding, which must be paired with tax-exempt bond financing or 4% non-competitive Housing Credits; the ELI portion is a forgivable loan. A nonrefundable $3,000 application fee must be received by the deadline. Review the preservation definition in Exhibit B, applicant-eligibility restrictions and the bookmarked Exhibit A submission requirements before applying.

PHAs, Multifamily owners and inspection teams should review HUD's proposed NSPIRE scoring-notice revisions and submit comments by November 30, 2026 through Regulations.gov, docket HUD-2021-0005 (FR-6086-N-13). HUD seeks comments on incorporating the previously announced October 1, 2026 affirmative-requirements scoring date, correcting the 133-unit sampling boundary without changing sample sizes, and correcting two figures in a scoring example. This comment window does not postpone October 1 scoring. The scoring notice does not apply to HCV or PBV programs.

PHAs, covered recipients and contractors should submit comments by Friday, December 4, 2026 sharing their experience, challenges and recommendations on future Section 3 benchmarks and goals. The current 25% total labor-hours and 5% targeted worker labor-hour ratios are unchanged; the benchmark notice takes effect November 4, 2026, which is separate from the comment deadline.

HUD Multifamily Housing owners must fully comply with HOTMA Sections 102 and 104 and revised income and asset documentation requirements for income certifications effective on or after January 1, 2027. Review tenant selection and EIV policies, tenant notices, revised leases, consent forms and software readiness under Section 6.2. Before this date, HOTMA tenant file errors during Management and Occupancy Reviews are observations with corrective actions; on and after this date they may become findings, and earlier observations must be corrected. PHAs administering HCV, PBV and Section 8 Moderate Rehabilitation programs must comply with the deferred NSPIRE inspection provisions by February 1, 2027. Notify participating owners and families, train inspectors, and confirm any HUD-approved variations or alternative inspection methods. Carbon monoxide and smoke-alarm requirements already apply and are not delayed by this extension. Inspections started before a PHA's transition remain subject to the standards in effect when inspected until the inspection process is resolved. HUD continues to accept transition-date notifications and updates after September 30, 2026.
